The Great Mistake by Jonathan Lee Summary

An exultant novel of New York City at the turn of the twentieth century, about one man's rise to fame and fortune, and his mysterious murder—“engrossing” (Wall Street Journal), “immersive” (The New Yorker), and “seriously entertaining” (The Sunday Times, London). Andrew Haswell Green is dead, shot at the venerable age of eighty-three, when he thought life could hold no more surprises. The killing—on Park Avenue in broad daylight, on Friday the thirteenth—shook the city. Born to a struggling farmer, Green was a self-made man without whom there would be no Central Park, no Metropolitan Museum of Art, no Museum of Natural History, no New York Public Library. But Green had a secret, a life locked within him that now, in the hour of his death, may finally break free. A work of tremendous depth and piercing emotion, The Great Mistake is the story of a city transformed, a murder that made a private man infamous, and a portrait of a singular individual who found the world closed off to him—yet enlarged it.

The Poet's Mistake by Erica McAlpine Summary

What our tendency to justify the mistakes in poems reveals about our faith in poetry—and about how we read Keats mixed up Cortez and Balboa. Heaney misremembered the name of one of Wordsworth's lakes. Poetry—even by the greats—is rife with mistakes. In The Poet's Mistake, critic and poet Erica McAlpine gathers together for the first time numerous instances of these errors, from well-known historical gaffes to never-before-noticed grammatical incongruities, misspellings, and solecisms. But unlike the many critics and other readers who consider such errors felicitous or essential to the work itself, she makes a compelling case for calling a mistake a mistake, arguing that denying the possibility of error does a disservice to poets and their poems. Tracing the temptation to justify poets' errors from Aristotle through Freud, McAlpine demonstrates that the study of poetry's mistakes is also a study of critical attitudes toward mistakes, which are usually too generous—and often at the expense of the poet's intentions. Through remarkable close readings of Wordsworth, Keats, Browning, Clare, Dickinson, Crane, Bishop, Heaney, Ashbery, and others, The Poet's Mistake shows that errors are an inevitable part of poetry's making and that our responses to them reveal a great deal about our faith in poetry—and about how we read.

Was the Reformation a Mistake? by Matthew Levering Summary

Was the Reformation a mistake? In its actual historical context, it hardly seems fair to call the Reformation a "mistake." In 1517, the Church was in need of a spiritual and theological reform. The issues raised by Renaissance humanism - and by the profound corruption of the Church's leaders, the Avignon papacy, and the Great Schism in the fourteenth and fifteenth centuries - lingered unresolved. What were key theological problems that led to the Reformation? Theologian Matthew Levering helps readers see these questions from a Catholic perspective. Surveying nine key themes - Scripture, Mary, Eucharist, Monasticism, Justification and Merit, Saints Priesthood, and Scripture - he examines the positions of Martin Luther and makes a case that the Catholic position is biblically defensible once one allows for the variety of biblically warranted modes of interpreting Scripture. At the same time, Levering makes clear that he cannot "prove" the Catholic case. The book concludes with a spirited response by "mere Protestant" theologian Kevin J. Vanhoozer. X

Hitler's American Gamble by Brendan Simms,Charlie Laderman Summary

A riveting account of the five most crucial days in twentieth-century diplomatic history: from Pearl Harbor to Hitler’s declaration of war on the United States By early December 1941, war had changed much of the world beyond recognition. Nazi Germany occupied most of the European continent, while in Asia, the Second Sino-Japanese War had turned China into a battleground. But these conflicts were not yet inextricably linked—and the United States remained at peace. Hitler’s American Gamble recounts the five days that upended everything: December 7 to 11. Tracing developments in real time and backed by deep archival research, historians Brendan Simms and Charlie Laderman show how Hitler’s intervention was not the inexplicable decision of a man so bloodthirsty that he forgot all strategy, but a calculated risk that can only be understood in a truly global context. This book reveals how December 11, not Pearl Harbor, was the real watershed that created a world war and transformed international history.

Economic Analysis of the DCFR by Filomena Chirico,Pierre Larouche Summary

The Economic Impact Group (EIG) was created to support the work on the DCFR with insights from law and economics. It brings together a number of leading European law and economics scholars. The Group looked at the main elements of the DCFR with two questions in mind: from an economic perspective, is it sensible to harmonize private law across Europe for this specific element, and is the solution chosen in the DCFR optimal? This book presents the outcome of the work of the EIG. It deals with key issues such as the function of contract law, contract formation, good faith, non-discrimination, specific performance versus damages, standard contractual terms and consumer protection in contract law. The EIG complements the work of the drafters of the DCFR with insightful and critical assessments, based on the well-established law and economics literature.

Was the American Revolution a Mistake? by Burton Weltman Summary

Why was George Washington dismayed by the outcome of the American Revolution? Would slavery still exist if the South had not seceded from the Union in 1861? Might socialists rule America today if Teddy Roosevelt had not run for President and lost in 1912? History is full of contingencies. People confront problems and debate options for solving them. Then they make a choice and face the consequences of their choice. Often they wonder if a different choice might have been better. Was the American Revolution a mistake? Was racial segregation inevitable? Was the Cold War necessary? Americans have repeatedly asked these sorts of questions as they examined the consequences of their choices. This is a book about revisiting crucial choices people made in history and examining the consequences of those choices for them and for us. It demonstrates a method of teaching history that recreates events as people experienced them, and asks important questions that troubled them but that rarely appear in conventional textbooks. Unlike conventional methods that often reduce history to names, dates and factoids for students to memorize, it is a method that brings past debates to life, the losers' as well as the winners' points of view, and makes the subject exciting. In studying history as choice, students examine the problems people faced, their options for solving them, their decision-making processes, and the choices they made. Then students evaluate the consequences of those choices both for people in the past and us today. They explore what might have happened if different choices had been made. Finally, students relate the consequences of those past choices to problems we face today and the choices we need to make. History as choice is a practical and practicable method. It has been designed to satisfy the curriculum goals of the National Council for the Social Studies, and the book explains how it can be used to satisfy any state or local curriculum standards. The book also identifies and illustrates resources that can be used with this method -- from data bases to popular music -- and explains how teachers can gradually integrate it into their courses. In the first part of the book, the method of history as choice is explained using the question of whether the American Revolution was a mistake as a case in point. The second part of the book explores thirteen other questions about significant issues and events in American history as additional examples of how one might teach history as choice.

Retroactivity and the Common Law by Ben Juratowitch Summary

This book analyses the common law's approach to retroactivity. The central claim is that when a court considers whether to develop or change a common law rule the retroactive effect of doing so should explicitly be considered and, informed by the common law's approach to statutory construction, presumptively be resisted. As a platform for this claim a definition of 'retroactivity' is established and a review of the history of retroactivity in the common law is provided. It is then argued that certainty, particularly in the form of an ability to rely on the law, and a conception of negative liberty, constitute rationales for a general presumption against retroactivity at a level of abstraction applicable both to the construction of statutes and to developing or changing common law rules. The presumption against retroactivity in the construction of statutes is analysed, and one conclusion reached is that the presumption is a principle of the common law independent of legislative intent. Across private, public and criminal law, the retroactive effect of judicial decisions that develop or change common law rules is then considered in detail. 'Prospective overruling' is examined as a potential means to control the retroactive effect of some judicial decisions, but it is argued that prospective overruling should be regarded as constitutionally impermissible. The book is primarily concerned with English and Australian law, although cases from other common law jurisdictions, particularly Canada and New Zealand, are also discussed. The conclusion is that in statutory construction and the adjudication of common law rules there should be a consistently strong presumption against retroactivity, motivated by the common law's concern for certainty and liberty, and defeasible only to strong reasons. 'Ben Juratowitch not only gives an account of the operation of the presumption, but also teases out the policies which underlie the different rules. This is particularly welcome. Lawyers and judges often seem less than sure-footed when confronted by questions in this field. By giving us an insight into the policies, the author provides a basis for more satisfactory decision-making in the future. ...The author not only discusses the recent cases but examines the question in the light of authority in other Commonwealth jurisdictions and with due regard to the more theoretical literature. This is a valuable contribution to what is an important current debate in the law. Happily, Ben Juratowitch has succeeded in making his study not only useful, but interesting and enjoyable.' The Future of Contract Law in Latin America by Rodrigo Momberg,Stefan Vogenauer Summary

This book presents, analyses and evaluates the Principles of Latin American Contract Law (PLACL), a recent set of provisions aiming at the harmonisation of contract law at a regional level. As such, the PLACL are the most recent exponent of the many proposals for transnational sets of 'principles of contract law' that were drafted or published over the past 20 years, either at the global or the regional level. These include the UNIDROIT Principles of International Commercial Contracts, the Principles of European Contract Law, the (European) Draft Common Frame of Reference and the Principles of Asian Contract Law. The PLACL are the product of a working group comprising legal academics from Argentina, Brazil, Colombia, Chile, Paraguay, Uruguay and Venezuela. The 111 articles of the instrument deal with problems of general contract law, such as formation, interpretation and performance of contracts, as well as remedies for breach. The book aims to introduce the PLACL to an international audience by putting them in their historical and comparative context, including other transnational harmonisation measures and initiatives. The contributions are authored by drafters of the PLACL and contract law experts from Europe and Latin America.

The Common European Sales Law in Context by Gerhard Dannemann,Stefan Vogenauer Summary

European Contract Law unification projects have recently advanced from the Draft Common Frame of Reference (2009) to a European Commission proposal for an optional Common European Sales Law (2011) which is to facilitate cross-border marketing. This book investigates for the first time how CESL and DCFR rules would interact with various aspects of domestic law, represented by English and German law. Nineteen chapters, co-authored by British and German scholars, examine such interface issues for eg pre-contractual relationships, notions of contract, formation, interpretation, and remedies, extending to non-discrimination, third parties, transfers or rights, aspects of property law, and collective proceedings. They go beyond a critical analysis of CESL and DCFR rules by demonstrating where and how CESL rules would interact with neighbouring areas of English and German law before English and German courts, how domestic traditions might influence the application, which aspects might motivate sellers and buyers to choose or reject CESL, and which might serve as model for national legislators. The findings are summarized in the final two chapters.
